Stubblefield) announced today. “He is talking with Ms. Bianca Jagger’s attorney, Ryan S. Goldstein, and Alana Stewart’s attorney, Jerry L. Kay, regarding combining efforts to get “National Attention To The Insidious Issue Devastating Thousands Of Families From Across The U.S.A.” Including Ms. Bianca Jagger, [Ex-wife of Rolling Stone lead, Mick Jagger] & Alana Stewart [Ex- wife of rock star, Rod Stewart] Mr. Whitenack states, “We feel our clients have a voice that can be heard, where most do not”. Mr. Whitenack states, “His client, along with Ms. Jagger and Ms. Stewart, has suffered from Intentional Harmful Infliction by those who, like “PCS” & “Thaler” who would rather lie and save their personal wealth, than protect the health and safety of their fellow woman and man!” Mr. Whitenack further states, “The issue of ill health and cancer, brought on by exposure to toxic mold in our schools and other public buildings is being hotly debated, throughout the country, in many different forums, as we speak. Ms. Dee wants her story to be told. She does not want to see others suffer the same fear of cancer and toxic effects that she is suffering!”

Ms. Dee states, “Bianca, Alana and I will be influential women with first hand experience, regarding our awareness of toxic mold exposure and the life time fear of cancer.” Ms Dee further states, “If it is this hard for Bianca Jagger, and Alana Stewart, who have been married to rock stars, imagine how difficult it is for me, and those who don’t have celebrity status, don’t have a snowball’s chance in hell, of ever being heard to protect our health and safety.   United we Stand or Divided We Fall.  This is an issue that is devastating many low-income families that are at the mercy of their slumlords. Her attorney, Scott B. Whitenack agrees. He has also spoken with Famed Woman’s Rights & Causes Attorney, Glory Allred regarding her role in helping Ms. Dee, and others like her, in order to bring National Attention To “This Tragic Toxic Issue!” Mr. Whitenack states, “In a court of law, and through the testimony of Paul Jennings, Shannon Meddock, Karen Thaler, Brad Palfrey, John Guy, Liz Goldman, and other admitted managers and employees of PCS, “Ms. Dee has proven the intentional fraud and negligence perpetrated by her prior landlord, PCS.”

Ms Dee further states, “By “PCS” &“THALER” willfully exposing me to toxic molds/mycotoxins, that are known carcinogenic, there is a genuine possibility that I will have cancer in the future!  I have to live with this knowledge everyday of my life.  I am already sick from the toxins and the fear that this will turn into cancer is a horrible reality, more than words can express! I’m only 35 years old, and I should have a bright and energetic future in front of me”, Dee said. “PCS and “Thaler” knew what they were exposing me to, kept me in this toxic unit, and they concealed it from me in order to save a few bucks. I feel completely violated and cheated out of a lifetime of good health. I can’t stop thinking about all the woman and children and their families, in substandard housing who are suffering the same toxic fate and lifetime fear of cancer!”

Mr. Whitenack says, “He wants to emphasize that everyone who has a little mildew in his or her shower should not be worried about cancer. But if they are someone, like Ms. Dee, who has experienced cognitive and neurological dysfunction from mold in their bloodstream, then the potential of future cancer is real.” 

Ms. Dee further states, “She became aware of how toxic Stachybotrys was, from watching NBC Nightly News in late June 2001.  She printed the web page for the segment, and it described the report as follows:

”Stachybotrys is considered toxic mold. We know exactly how dangerous the microtoxins produced by this organism are. They are extremely dangerous,” says Dr. Straus. It’s so dangerous; it’s listed in a military manual as an agent of “BIOLOGICAL WARFARE!” Experts say a small exposure at home can make you sick. “Such things as nose bleeds, vomiting, hair loss, diarrhea, cognitive dysfunction and hearing loss. Very serious health implications.” Says Dr. Straus.”

Ms. Dee has already testified, That after she heard and read this, she called Dr. David C. Straus, Ph.D, form Texas Tech University. She reviewed other US government mold/mycotoxins studies, collegic fungal disease studies and information that Ms. Dee came in contact with through the media. All these reports have confirmed Ms. Dee’s fears. They demonstrate an understanding by numerous medical researchers and clinicians of the correlation between mold/mycotoxins exposure and cancer.”

“Ms. Dee has proven to the jury “She must now live with an increased vulnerability to serious disease or cancer”. Concluded Whitenack. “It is axiomatic that she should receive periodic medical monitoring to detect the onset of disease or cancer at the earliest possible time. Early diagnostics is unquestionably important to increase the chances of effective treatment when the beginning signs of cancer set in! We are expecting the jury to award Ms. Dee damages for the present value of the costs of such monitoring, brain impairment, for general disruption of her life, for invasion of her privacy in the amount of $3.9 million and for punitive damages in excess of 10 x this amount, $30M + before the end of April 2005.

 This is based on “PCS’s” & Thaler’s “Conscious & Reckless Disregard For The Rights & Safety Of Their Tenant.” Ms. Dee states, “PCS’s” Motto for The “Luxury Mammoth Park Towers Apartment,” where Ms. Dee resided and was exposed to toxic mold was “Better Living Better Life?”  The question is, “Better Living, Better Life” for who? Tenants who reside there or those who cash the tenant’s checks? 

Mr. Whitenack’ states, “PCS, it’s representatives, and their attorney, John Barrett, Jr., of Parker * Stanbury, LLP, are so desperate, they have stopped at nothing short of: “Stalking, Harassing & Intimidation” of Ms. Dee and Mr. Whitenack, in order to prevent Ms. Dee’s story from being told. “PCS and Toxic Mold has literally changed my life forever”, said Ms. Dee.  “What greedy landlords are doing to tenants by painting over the mold, or to conducting dangerous testing, while a human is residing in these units, is pure evil. It has to stop, and the AWARNESS MUST START”!          

On March 16, 2005, Paul Jennings of PCS testified that he believed Ms. Dee got what she bargained for, “A Better Living A Better Life”.

“Q. And with respect to the motto of PCS, you approved “better living, better life”, isn’t that correct?

A. That was our goal, yes.

Q. And with respect to the motto of PCS,

Q. What do you mean that was your goal?

A. We would set a standard and work hard towards trying to achieve it.

Q. And with respect to unit 307, do you believe that you met that goal?

A. I think the fact that we had moved her originally when requested was clearly an effort that we went out of our way, when we didn’t have to, to move her, per her request, to another unit on her own, her own discretion, because she believed it was a better unit than she was previously in as I understood it.

.....MR. WHITENACK: Move to Strike as being non-responsive.

THE COURT: The answer in its entirety is stricken. The jury is instructed to disregard it.

The question was: And with respect to unit 307, do you believe that you met that goal?

THE WITNESS: Yes

THE COURT: Thank you.”

And how do you explain “Luxury Living, Better Living, Better Life,” as Ms. Dee now has to live in fear and be continually monitored for cancer for the remainder of her life?

 The jury trial at the downtown L.A. Superior Court Dept. 19, Judge Warren Ettinger, 111 N. Hill St. continues at 9 am on April 19, 2005 and will continued until May 3, 2005.
